VESTIGIUM operates as a fragrance editor within European Union law. This page details the legal framework under which our products are sourced, repackaged, and offered, and the rights afforded to both our customers and the trademark holders of the houses we curate.

Trademark holder contact

VESTIGIUM undertakes to respond within 72 working hours and to cooperate in good faith on any reasonable request.
03Authenticity & traceability
Every flacon source used by VESTIGIUM is acquired from an authorised reseller in the European Union: official brand boutiques, partner department stores, or authorised distributors. No grey market, no unauthorised parallel imports, no second-hand sourcing.
VESTIGIUM maintains for every flacon source:
- The original purchase invoice (kept for 10 years)
- The acquisition date and reseller identification
- The manufacturing batch code of the source bottle
- The date the source bottle was opened
Every VESTIGIUM decant carries a unique lot number linking it back to its source bottle in our archive. On motivated request, the full traceability chain can be communicated to the customer or to a competent authority.
04Reconditioning & presentation
VESTIGIUM reconditions authentic fragrances into independent atomizers under controlled conditions. The reconditioning operation is conducted in compliance with the Bristol-Myers Squibb v Paranova jurisprudence (CJEU C-427/93) and the Boehringer Ingelheim case law (CJEU C-348/04), which authorise the repackaging of authentic trademarked goods provided that:
- The repackaging is necessary to access a specific market segment (here: the discovery / sampling segment, which the original rights holder does not address in equivalent format)
- The original condition of the product is not affected (the olfactive content is strictly identical to the source bottle, verified by analytical sampling on production lots)
- The reconditioner is clearly identified on each decant (« VESTIGIUM » is the only commercial entity named on the atomizer label and outer packaging)
- The presentation is not damaging to the brand's reputation (medical-grade glass, professional finish, no use of the original brand's distinctive visual identity)
- The rights holder may, at any time, request information about a specific production through contact@vestigiumfragrance.com
VESTIGIUM does not reproduce, in whole or in part, the original packaging, distinctive visual codes, typography, or color schemes of the brands whose products are reconditioned. The VESTIGIUM visual identity (ivory / gold / black, Cormorant Garamond + Manrope) is independently developed and bears no resemblance to any of the brands listed in section 02.
05Cosmetic regulation framework
VESTIGIUM acknowledges that fragrance decants placed on the European market constitute cosmetic products within the meaning of Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products, as transposed into French law (articles L.5131-1 et seq. of the Code de la santé publique).
This regulation governs in particular:
- The designation of a « Responsible Person » established in the European Union
- The labelling of each product (article 19): identification of the responsible person, nominal content, period after opening, batch number, function, list of ingredients (INCI)
- The maintenance of a Product Information File (PIF) including the cosmetic product safety assessment
- The notification of the product on the Cosmetic Products Notification Portal (CPNP) prior to placing on the market

Safety & allergens
VESTIGIUM fragrances are cosmetic products intended for external use only. Before use:
- Verify the list of ingredients on the decant label and avoid use in case of known allergy to any component
- Avoid contact with eyes and mucous membranes
- Do not ingest
- Keep out of reach of children
- Store away from direct light and elevated temperature
In case of adverse reaction, cease use immediately and contact contact@vestigiumfragrance.com with description of symptoms and batch number of the decant.
06Customer rights
Right of withdrawal
Per article L.221-18 of the French Consumer Code, the Customer has 14 days from order receipt to exercise the right of withdrawal, without justification needed. This right does not apply to products whose seal has been broken, for health or hygiene protection (article L.221-28 3° Code de la consommation), which includes any VESTIGIUM decant whose atomizer has been used.
Legal warranties
All VESTIGIUM products benefit from the legal conformity warranty (articles L.217-4 et seq. Code de la consommation) and the hidden defects warranty (articles 1641 et seq. Code civil).
Mediation
Per article L.612-1 of the French Consumer Code, the Customer may refer free of charge to a consumer mediator. VESTIGIUM designates an accredited consumer mediator (designation in progress; contact details published before sales open) for any unresolved dispute.

Personal data
Personal data processing is governed by our Privacy policy. Under the General Data Protection Regulation (Regulation (EU) 2016/679), the Customer enjoys rights of access, rectification, erasure, portability, and opposition.
07Applicable law & jurisdiction
The present site, its general terms and conditions, and any transaction concluded thereon are governed by French law. Any dispute that cannot be resolved amicably or through mediation will be brought before the competent French courts.
